CodeADX LLC — Privacy Policy

This Privacy Policy explains what information CodeADX LLC (“CodeADX,” “we,” “us”) collects, how we use it, and the steps we take to protect it in providing our Services — including the CodeADX marketplace and MediaPilot, our broadcast and audio content platform for radio, streaming, podcast, and other media use — and operating the CodeADX Platform. This Privacy Policy is a disclosure, not an agreement, and may be modified at any time; changes are indicated by updating the Effective Date above. It applies to all users of the Services and the CodeADX Platform. Capitalized terms used without definition have the meanings given in the current CodeADX Terms & Conditions.

This Privacy Policy is organized in four parts, mirroring the Terms & Conditions: Part I – General Privacy Practices applies to all users. Part II – Marketplace describes data practices specific to Content Creators and Advertisers. Part III – MediaPilot describes data practices specific to subscribing Stations, including voice recordings and AI Voice Models. Part IV – Listeners & Site Visitors covers people who use a CodeADX-hosted site or the CodeADX player bar on any media publisher’s site — radio stations, podcasters, or other media.

Part I – General Privacy Practices

The following practices apply to all users of the Services.

1. Information Collected Automatically

When you use the CodeADX Platform we may automatically collect device information (device type, operating system, browser type), log information (access times, pages viewed, IP address), usage information (content viewed, search queries, features and advertisements interacted with), and approximate location information (derived from IP address). We use this data to provide, secure, and improve the Services, analyze trends, administer the Platform, personalize your experience, prevent fraud, and comply with legal obligations. We use cookies and similar technologies to collect some of this data; you can disable cookies in your browser settings, but some features may not function fully without them.

2. Analytics

We use Google Analytics to understand how users interact with the Services, which collects information such as IP address, browser type, operating system, pages viewed, and visit date/time, and may use cookies. Where required by law, we obtain consent for non-essential cookies before placing them. You can also opt out with the Google Analytics Opt-out Browser Add-on or by disabling cookies (some features may not function fully). Analytics data may be shared with Google in aggregated, anonymized form to improve their services. Certain analytics and advertising disclosures may qualify as a “sale” or “sharing” under California law, as described in Section 8.

3. Payment Processors

CodeADX uses third-party payment processors; our current processors are Stripe (all payments, and U.S. payouts) and PayPal (international Content Creator payouts). We may change processors at any time and will update this Privacy Policy accordingly. Users required to create a Stripe account do so under separate agreements with Stripe. CodeADX stores on its servers the Stripe account identifier associated with each Advertiser and Content Creator to facilitate payments. Card numbers, billing details, and bank account information are collected and stored by Stripe — not by CodeADX — in accordance with Stripe’s privacy policy and terms of service, and CodeADX is not responsible for Stripe’s or PayPal’s compliance with their own policies.

4. Information from Third Parties

We may receive information from third-party sources such as social media platforms, other service providers, and our payment processors, which we use to enhance the Services, verify information provided by users, detect and prevent fraud, comply with law, and enforce our rights. We do not share this information except as necessary to provide the Services, as required by law, or to enforce our rights.

5. How We Use Information

We use the information described in this Privacy Policy to: provide, operate, and improve the Services (including generating MediaPilot Scripts and Break audio); create and display Content Creator profiles; facilitate Deals and process payments and payouts; communicate with you about your account; personalize your experience; secure the Platform and prevent fraud and abuse; comply with legal obligations; and enforce our agreements. As described in the Terms & Conditions, CodeADX may also use aggregated, de-identified data derived from use of MediaPilot to develop, train, improve, and benchmark its products and services, including AI models; such data does not identify any Station or individual.

6. Information Sharing

We do not sell or rent your personal information to third parties, except that certain analytics/advertising disclosures may be treated as “sales” or “sharing” under California law as described in Sections 2 and 8. We share information with: third-party service providers who assist in providing the Services (including payment processors, hosting providers, the voice-cloning vendor described in Part III, and storage services a user connects), solely to provide those services; Advertisers, with whom we may share Content Creator content and profile information for prospective Deals; and authorities or other parties where required by law or to protect our rights. We may also disclose information in connection with a reorganization, merger, or sale of assets as described in the Terms & Conditions.

7. Data Security and Retention

We take measures we believe are appropriate to protect your information from unauthorized access, use, or disclosure, including secure servers, encryption of sensitive information in transit, and monitoring for security vulnerabilities. No system is perfectly secure, and we cannot guarantee absolute security. We retain personal information no longer than necessary for the purposes for which it was collected, or as required by applicable law and our retention policies, which reflect applicable statutes of limitation and statutory obligations. Product-specific retention practices are described in Parts II and III.

8. Your California Privacy Rights

This section applies to California residents. The personal information we collect is described in this Privacy Policy and includes identifiers such as name, physical address, email address, username and credentials, social media handles, IP address, and unique device identifiers.

Disclosures for valuable consideration. As is common among businesses operating websites, we may disclose certain identifiers, website/app usage information, and inferences to our social media, advertising, and analytics partners; these disclosures may qualify as “sales” or “sharing” for cross-context behavioral advertising under California law. You may opt out as described below.

Your rights. Subject to verification and applicable law, you have the right to know the categories and specific pieces of personal information we have collected about you, the sources, the business purposes, and the categories of third parties to whom it was disclosed, sold, or shared; the right to correct inaccurate personal information; the right to delete personal information (note that deletion may prevent us from providing services that require it); and the right to opt out of sales, sharing for cross-context behavioral advertising, targeted advertising, and profiling. You may also opt out of collection by certain advertising partners at aboutads.info and thetradedesk.com/general/privacy.

Exercising rights; verification. Submit requests to info@codeadx.me or by mail to the address above. We may take steps to verify your request — including asking for your name, contact information, and information about your account or prior transactions — before processing it. We will respond within the time required by law (generally 45 days, extendable as permitted), and will deliver information electronically or by mail at your option, in a portable and, where feasible, machine-readable format.

Authorized agents. You may designate an authorized agent to submit requests on your behalf with your signed written permission; we may require proof of that permission, verification of your identity, or direct confirmation from you.

Nondiscrimination. We will not discriminate against you for exercising these rights — including by denying services, charging different prices, or providing a different level of quality — except where a difference is reasonably related to the value provided by your information, as permitted by law.

Global Privacy Control. Where required by law, we treat a Global Privacy Control (GPC) signal from your browser as a request to opt out of the sale or sharing of your personal information.

Other U.S. states. If you reside in another U.S. state with a comprehensive privacy law — including Connecticut, Virginia, Colorado, Utah, Texas, and Oregon — you may have similar rights of access, correction, deletion, portability, and opt-out of targeted advertising, sales, or profiling, and (where provided by your state’s law) the right to appeal a refused request. 9. Your EU and UK Privacy Rights

For personal data processed under the GDPR or UK GDPR, CodeADX LLC is the data controller (or, for data we process on behalf of a business customer, the processor). We process personal data on the following legal bases: performance of a contract (providing the Services you have signed up for); our legitimate interests (operating, securing, and improving the Services, and preventing fraud); consent, where we ask for it; and compliance with legal obligations. CodeADX is based in the United States, and personal data we collect is processed on servers in the United States; where we transfer personal data from the EU, UK, or other jurisdictions with transfer restrictions, we rely on appropriate safeguards such as standard contractual clauses, as described in the Terms & Conditions.

If you are located in the European Union or the United Kingdom, you may have rights under the GDPR or UK GDPR, including: the right of access to, and a copy of, your personal data; the right to rectification of inaccurate or incomplete data; the right to erasure in certain circumstances; the right to restrict processing in certain circumstances; the right to data portability in a structured, commonly used, machine-readable format; and the right to object to processing in certain circumstances. To exercise these rights, contact info@codeadx.me. We will respond in accordance with applicable law; where we cannot fulfill a request (for example, because of legal obligations or the privacy rights of others), we will explain why. You also have the right to lodge a complaint with your supervisory authority. For business customers, CodeADX will enter into a data processing agreement upon written request, as described in the Terms & Conditions.

10. Privacy Rights in Other Jurisdictions

Many jurisdictions outside the United States, the European Union, and the United Kingdom have their own data protection laws — for example, Brazil’s LGPD, Canada’s PIPEDA, and Australia’s Privacy Act — which commonly provide rights such as confirmation of processing, access, correction, deletion or anonymization, portability, information about sharing, and withdrawal of consent. If the data protection law of your jurisdiction grants you rights in personal information we hold, we will honor verified requests to the extent required by that law. All such requests may be sent to info@codeadx.me.

11. Children

The Services are intended for users 18 and older, consistent with the eligibility requirements in the Terms & Conditions. We do not knowingly collect personal information from children under 18; if you believe a child has provided us personal information, contact info@codeadx.me and we will delete it.

12. Changes to this Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will post the updated policy on our website and update the Effective Date above.

Part II – Marketplace

The following practices apply to Content Creators and Advertisers using the Marketplace Services, in addition to Part I.

1. Information Collected from Content Creators

Account and contact information. Name, email address, and contact information provided when you sign up for the CodeADX marketplace, used to communicate with you about your account and the Services, to comply with legal requirements, and to enforce our rights.

Payout information. U.S.-based Content Creators are paid via Stripe (see Part I, Section 3). For Content Creators paid via PayPal (currently used for payouts outside the United States), we collect and store the email address associated with your PayPal account for the sole purpose of sending payouts; PayPal payments are processed under PayPal’s own terms and privacy policy.

Content and profile information. Information about the content you upload or connect — including text, images, video, and content feeds such as RSS, YouTube, and other social media feeds — used to build your Content Creator profile, display and promote your content to potential Advertisers, and operate any Hosted Services you purchase. Feed data may include personal information such as your name, email, and social media handles.

2. Information Collected from Advertisers

Account and contact information. Name, email address, and contact information provided when you sign up, used for the same purposes described above.

Payment information. Payment is collected through Stripe (see Part I, Section 3). CodeADX does not collect or store card numbers or bank account details on its own servers.

3. Information Collected from Shopify Stores

CodeADX uses the Shopify API to retrieve specific information from connected Shopify stores to provide the Marketplace Services:

• Read_Orders — order details and transaction history, to track and process orders, calculate commissions, and pay Content Creators accurately.
• Read_Checkouts — checkout data such as discount codes and applied discounts, to calculate commission payments.
• Read_Products — product names, descriptions, and prices, needed to promote and sell products through the platform.
• Read_Discounts — discount codes, pricing rules, and promotions, to list products available for promotion.
• Write_Discounts — the ability to create and manage discounts within a store, to execute promotional campaigns.
• Read_Price_Rules — pricing strategies and rules set by the store, to determine appropriate pricing and commission structures.

Data collected from Shopify stores is used exclusively to provide the CodeADX Services and facilitate the agreed transactions between stores and Content Creators, is not shared with third parties except as needed to fulfill our obligations or as permitted by law, and is retained only as long as necessary for those purposes or as required by law, after which it is securely deleted or anonymized. By connecting your Shopify store you consent to the collection, use, and processing of your store data as described in this section.

Part III – MediaPilot

The following practices apply to Stations subscribing to MediaPilot, in addition to Part I.

1. Information Collected from Stations

Account and contact information. Name, business contact details, and account credentials for Station personnel who administer a MediaPilot Subscription.

Station information. MediaPilot populates station details — such as station name, location, format, slogans, contests and promotions, and on-air talent lineup — primarily through automated research of publicly available sources, refreshed periodically rather than stored as a fixed record. Station personnel may review, edit, and supplement this information in the MediaPilot interface. Talent lineup information may include the names and publicly available photos of a Station’s on-air personalities; this is personal information about those individuals obtained from public sources, used solely to provide MediaPilot to their Station. An on-air personality who wants their information corrected or removed may contact info@codeadx.me.

Music logs and playlists. Logs and playlists a Station uploads or connects, used to generate Scripts that reference the programming around each Break.

Connected services. If a Station connects a third-party storage service (such as Dropbox) for exports or imports, we store the connection credentials/tokens needed to deliver files to, and read files from, the folders the Station designates. Files delivered to those services are governed by that provider’s own terms and privacy policy.

2. Voice Recordings and AI Voice Models

If a Station uploads a voice recording to create a cloned Voice Model, the recording and resulting Voice Model are processed solely to provide the requested voice-cloning functionality. This includes transmitting the recording to our third-party voice-cloning vendor (currently ElevenLabs), whose processing is governed by its own terms of service, which the uploading Station accepts at the point of upload. The Station — not CodeADX — is responsible for obtaining consent from the individual whose voice is submitted, as set out in the Terms & Conditions. Voice recordings and Voice Models are not used to create voices for any other customer and are not sold. Stations may instead use CodeADX-provided Studio Voices, which involve no upload of the Station’s own recordings. To request deletion of a voice recording or Voice Model, contact info@codeadx.me; we will honor verified requests subject to any retention required or permitted by law.

3. Companion App and Companion Site (Listeners)

Parts I–III of this Privacy Policy cover Station personnel who use MediaPilot. Listeners who use a Station’s Companion Site/App — delivered through CodeADX-hosted sites or the CodeADX player bar — are covered by Part IV below.

4. MediaPilot Data Retention

Station details populated through automated research are periodically refreshed rather than stored as a fixed record. Stations are responsible for downloading Scripts and Break audio they wish to keep during their Subscription. Where a Station opts in at the time of export, we retain the exported Script and recording and may use them to personalize MediaPilot for that Station and to improve MediaPilot and CodeADX content-generation systems generally, including for other customers, as described in the Terms & Conditions; a Station’s voice is never used to generate audio for any other customer. Following termination, CodeADX may retain and use data on an aggregated, de-identified basis as described in Part I, Section 5 and the Terms & Conditions.

Part IV – Listeners & Site Visitors

This Part applies to listeners and visitors who use a website or web experience powered by CodeADX technology, in addition to Part I — whether it belongs to a radio station, a podcaster, or any other media publisher. That technology takes two forms: (a) websites we host and operate on behalf of a media publisher, and (b) the CodeADX player bar — a patented player component a publisher installs on its own website. In both cases, the technology can convert the site into a progressive web app (“PWA”) that you may choose to install on your device for persistent listening. Although these sites carry the publisher’s branding, the CodeADX-provided technology is operated by CodeADX. Where the player bar is embedded in a site the publisher runs itself, this Part covers only the player bar and the CodeADX features it provides; the rest of that website is governed by the publisher’s own privacy policy.

1. Information We Collect from Listeners and Visitors

Listening and playback activity. Stream play, pause, and stop events, listening duration, and the station, podcast, or other media being played, used to operate the player and persistent-listening experience.

Music and content interactions. Song lookups, on-air sync interactions, and similar feature usage, used to provide those features. Where a music chat feature is offered and used, we collect the messages sent so the feature can respond; chat messages are processed using artificial intelligence, which may include transmission to third-party AI service providers. Do not include sensitive personal information in chat messages.

Usage, device, and notification information. Device type, operating system, browser type, IP address, approximate location derived from IP, pages viewed on hosted sites, PWA installation events, and — if you enable web or PWA notifications — the subscription token needed to deliver them (you can disable notifications in your browser or device settings). Anything you voluntarily submit through a hosted site or player feature (such as song requests or feedback) is also collected where the publisher offers those features.

Advertising. Where advertising is displayed on a hosted site or through the player, third-party advertisers or their partners may place cookies or similar technologies to recognize your device and measure or deliver ads. Those third parties’ collection is governed by their own privacy policies; opt-out choices are described in Part I, Sections 2 and 8.

YouTube API Services. Some features use YouTube API Services; by using those features you are also subject to the Google Privacy Policy at google.com/policies/privacy.

2. Use, Sharing, and Rights

We use this information to operate the player bar, hosted sites, and PWA functionality; maintain security and prevent abuse; understand usage in aggregate to improve the product; and comply with legal obligations. We do not sell listener or visitor personal information for monetary consideration. However, as described in Part I, Sections 2, 6, and 8, certain disclosures of identifiers, device or usage information, or inferences to advertising, social media, or analytics partners may be treated as a “sale” or “sharing” under applicable privacy law, including California law, even where no money changes hands. Where required by applicable law, listeners and visitors may opt out of such sale or sharing, targeted advertising, or profiling, and CodeADX honors qualifying opt-out preference signals such as Global Privacy Control. We may share aggregated, de-identified listening statistics with the publisher whose site or player you used; those statistics do not identify individual listeners. The rights described in Part I, Sections 8–10 apply to listeners and visitors; submit requests to info@codeadx.me. For questions about a publisher’s own content, contests, or the rest of their website, contact them directly.

3. Children

Hosted sites and the player bar are intended for users 18 and older and are not directed to children under 18. We do not knowingly collect personal information from anyone under 18; if you believe a person under 18 has provided us personal information, contact info@codeadx.me and we will delete it, subject to any retention required or permitted by applicable law.
